DATA PRIVACY NOTICE FOR BUSINESS CUSTOMERS
1. GENERAL INFORMATION & ADDRESSEE OF THIS PRIVACY NOTICE
This Privacy Notice addresses you as individuum in your function as employer or recruiter or as employee of an employer / recruiter (hereinafter “Business Customers”).
The protection of personal data is very important to JobCloud Ltd (hereinafter “we” or “JobCloud”). As the controller of your personal data, we therefore comply strictly with the Swiss Federal Act on Data Protection (hereinafter “Swiss FADP”).
We guarantee confidential treatment of all the personal data entrusted to us and assure that we will deal with such data with the greatest care and process the data in accordance with its purpose and only to the extent required by the purpose of the processing.
This Privacy Notice applies to your use of all JobCloud services and products, no matter whether you use our services and products on a JobCloud website (e.g. jobs.ch, jobup.ch, jobscout24.ch, jobcloud.ch, or jobcloud.ai; all of our websites shall be referred to collectively hereinafter as “Platforms”), on mobile applications (hereinafter “Apps”), by telephone or otherwise.
If you provide us with the personal data of other individuals (e.g. data of your employees, co-workers), please make sure that such individuals are aware of this Privacy Notice, and do not share their personal data with us unless you are entitled to do so and the personal data are correct. The individuals concerned should particularly be aware that by publishing job ads on our Platforms in accordance with your instructions, we make personal data available to third parties who visit our Platforms, in particular job seekers.
2. WHAT PERSONAL DATA DO WE USE AND FOR WHAT PURPOSES?
2.1 LEAD GENERATION
2.1 a) Purpose of use:
- We use personal data to identify Business Customer’s needs for our services and products (generate “Leads”) and initiate the contract negotiation.
2.1 b) Personal data concerned:
- We use business contact and identification data of you such as name, title, business e-mail address, business telephone number, business role, company name, customer number, as well as login data such as username and password. We store this data in our customer management system (“CRM system”).
2.2 ACCOUNT REGISTRATION, PERFORMANCE OF SERVICES, CONTRACT MANAGEMENT
2.2 a) Purpose of use:
- We use personal data to set-up the JobCloud Account and to perform our services, for customer management and for invoicing.
- When a Business Customer enters into a contract with JobCloud, we create a Business Customer account in our CRM system for that Business Customer and store the business contact details of you as the Business Customer’s contact person in the Business Customer account. If a Business Customer account already exists, your contact details will be updated as appropriate.
- When you are in contact with us, for example when you contact our sales personnel, when you write or call us, use our self-service, our chatbot or live chat, we use your data to answer to your requests.
- We may display your picture on behalf of the Business Customer in the Business Customer’s company profile if we are requested to do so by the Business Customer.
- If you use the Platform Youma pro, we use personal data to set-up the Youma Pro account and to perform our services with Youma Pro (e.g. communication with applicants).
2.2 b) Personal data concerned:
- We use business contact and identification data of you such as name, title, business e-mail address, business telephone number, business role, company name, customer number, as well as login data such as username and password. Moreover, you may provide us with additional information necessary for invoicing.
- We additionally for certain of the above uses use personal data to understand how and when you use our products, services and online offerings and what individual settings you make (language, functionalities etc).
- We also process your communication data (e-mails, written correspondence, type, time, and place of communications) and the content of your chatbot conversations.
- We process your photos, voice, and video data but only with your consent or if Business Customer provided us with such information in a context in which we can assume that Business Customer obtained your consent.
2.3 CUSTOMER SERVICE & PRODUCT SUPPORT
2.3 a) Purpose of use:
- We process your personal data if you reach out to JobCloud via a contact form on our websites, via e-mail, or by phone, via messenger service (e.g.,WhatsApp) or otherwise in order to provide Business Customer with support regarding our services and products.
2.3 b) Personal data concerned:
- We use business contact and identification data of you such as name, title, business e-mail address, business telephone number, business role, company name, customer number, as well as login data such as username and password.
- We process communication data such as content of e-mails, and written correspondences.
- Additionally, we may record your conversation with our sales personnel or customer support for quality management, service improvement, or training of JobCloud personnel but only with your consent. In this regard we may process data such as your photos, voice, and video.
2.4 MARKETING
2.4 a) Purpose of use:
- We use your contact information to send Business Customer information about similar products and services. You can opt out of receiving these notifications at any time.
- If you participate in our webinars or Business Customer events on services and products offered by us as well as various focal topics from the field of the labour market, we use your business contact information for sending follow-up communication and webinar materials and further information.
- We process your data if you enter your contact details to download white books or recordings of webinars from our website to benefit from our free content.
- If you consent to be filmed or photographed during our online webinar or customer event, we may process this data for marketing purposes. We may also use your photo provided to us by the Business Customer. If the Business Customer provides us with your photo, we assume that you consented to the provision and our use of the photo for customer reference. Moreover, if you provide us with a testimonial with or without photo, we may use this on emails or on our Platform.
2.4 b) Personal data concerned:
- We use business contact and identification data of you such as name, title, business e-mail address, business telephone number, business role, company name, customer number, as well as login data such as username and password.
- We process your photos, voice, and video data only with your consent or when we can reasonably assume that you consented.
2.5 MARKET RESEARCH, TREND ANALYSIS, PRODUCT AND SERVICE DEVELOPMENT
2.5 a) Purpose of use:
- We occasionally ask our Business Customers to take part in market studies, satisfaction analysis of webinars and Business Customer events as well as product surveys. We may use data that you provide to us in this context for service improvement and product development.
- We may use your personal data on job ads for trend analysis and product development (including for the purpose of developing and training our own artificial intelligence (“AI”) solutions or AI solutions that we use from third party service providers of us).
- We use the personal data for analytical purposes and improvement of our services. After you have registered and signed in with your login information, we are able to link your online usage data (e.g. how you use our Internet sites and services in your account) with other Business Customer data that we capture and process in conjunction with your usage of our products and services. We can then use that information to offer you services and functions in your JobCloud Account, for marketing purposes, for the evaluation, improvement, and new development of services and functions.
- We may use different personal data (communication data, usage data, contract data, data collected offline and online) to understand how and when you use our products, services, and online offerings and what individual settings you make. We use your data to derive your preferences, improve for the Business Customer our existing products and services and develop new ones. This information helps us to provide you with information and services which is most relevant for the Business Customer.
2.5 b) Personal data concerned:
- We use business contact and identification data of you such as name, title, business e-mail address, business telephone number, business role, company name, customer number, as well as login data such as username and password.
- We use usage data to understand how and when you use our products, services and online offerings and what individual settings you make (language, functionalities etc).
- Moreover, we use communication data (e-mails, written correspondence) and the content of your chatbot conversation for the purposes.
2.6 OTHER
Purpose of use & personal data concerned: We may use your personal data in addition for the following reasons:
- Crime prevention: Your personal data may be used to detect and prevent fraud or other illegal and undesired activities. We use among others business contact and identification data of you such as name, title, business e-mail address, business telephone number, business role, company name, customer number, as well as login data such as username and password and information about your usage of our products, services and online offerings.
- Holding of contests: We hold contests on a regular basis. The only personal data we use to hold such contests is the data collected specifically in the course of the contest after obtaining your express prior consent. Contest-specific terms of use and privacy notices are applicable.
3. DATA SECURITY
We use technical and organizational security measures to provide the data under management with state-of-the-art protection against accidental corruption or intentional manipulation, loss, destruction and unauthorized third-party access. Our security precautions are constantly keeping with the latest technological advances.
4. THIRD-PARTY OFFERS
JobCloud also presents third-party offers on its Platforms and in its e-mails and newsletters or provides links to third-party offers or websites. JobCloud assumes no liability for the collection and processing of personal data by third parties or their services and IT applications. The data protection provisions applicable to the relevant third-party provider will be applicable.
5. WHO RECEIVES MY PERSONAL DATA AND WHERE ARE THE RECIPIENTS LOCATED?
a) Service providers and other third parties:
In the context of our business activities and in line with the purposes of the data processing we may transfer data to third parties, insofar as such a transfer is permitted and we deem it appropriate, in order for them to process data for us or, as the case may be, their own purposes. In particular, the following categories of recipients may be concerned:
- service providers (such as e.g. banks, insurances, lawyers), including processors (such as e.g. IT providers);
- group companies;
- business partners;
- domestic and foreign authorities or courts;
- social media platforms;
- acquirers or parties interested in the acquisition of us or business divisions of us;
- other parties in possible or pending legal proceedings;
together “Recipients”.
b) Transmission to third countries:
The Recipients may be domiciled anywhere in the world and thus outside Switzerland. JobCloud shall ensure that a transmission is made only to such countries that have a data protection standard equivalent to Switzerland or if the Recipients are located in a country that does not provide for an adequate data protection if the transfer is in line with the Swiss FADP.
If you have questions about the specific Recipients, or would like to receive a copy of the data protection guarantees, please address your question to us (you find the contact details in Section 7).
6. YOUR RIGHTS
In accordance with and as far as provided by applicable law, you have the right to access, rectification and erasure of your personal data, the right to restriction of processing or to object to our data processing, in particular for direct marketing purposes, for profiling carried out for direct marketing purposes and for other legitimate interests in processing in addition to a right to receive certain personal data for transfer to another controller (data portability).
Please note, however, that we reserve the right to enforce statutory restrictions on our part, for example if we are obliged to retain or process certain data, have an overriding interest (insofar as we may invoke such interests) or need the data for asserting claims. If exercising certain rights will incur costs on you, we will notify you thereof in advance.
If you have given us your consent to process your personal data for certain purposes, we will process your personal data within the scope of and based on this consent, unless we have another legal basis, provided that we require one. Consent given can be withdrawn at any time, but this does not affect data processed prior to withdrawal.
In order to assert these rights, please contact us at the addresses provided in Section 7.
In addition, you have the right to enforce your rights in court or to lodge a complaint with the competent data protection authority. The competent data protection authority of Switzerland is the Federal Data Protection and Information Commissioner (http://www.edoeb.admin.ch).

DATA PRIVACY NOTICE FOR JOBSEEKERS
A. WHAT IS THIS PRIVACY POLICY ABOUT?
In this Privacy Policy, JobCloud AG (hereinafter “we” or “JobCloud”) explains how we process and protect personal data. Personal data is any information relating to an identified or identifiable person.
The protection of personal data is very important to us. That is why we pay strict attention to compliance with the applicable data protection regulations, primarily the Swiss Data Protection Act (hereinafter “CH FADP”) and, to the extent applicable by law in the specific case, the EU General Data Protection Regulation (hereinafter “EU GDPR”).
This Privacy Policy applies to the use of all JobCloud services and products, regardless of whether you use our services and products via a JobCloud website (e.g. jobs.ch, jobup.ch, jobscout24.ch, hereinafter all our websites together “JobCloud platforms”), via mobile applications (hereinafter “apps”), by telephone or otherwise; unless a specific privacy policy is posted for specific services and/or products, this Privacy Policy applies.
If you provide us with personal data of other persons (e.g. data of reference persons), please make sure that these persons are aware of this Privacy Policy and only provide us with their personal data if you are allowed to do so and if this personal data is correct.
Please note that (i) data on religious, philosophical, political or trade union views or activities, (ii) data on health (including genetic and biometric data), privacy or race or ethnicity, (iii) data on administrative and criminal prosecutions or sanctions as well as (iv) data on social assistance measures are considered particularly sensitive personal data under the CH FADP and a special category of personal data under the EU GDPR. Please do not provide us with such data.

F. WHICH PERSONAL DATA DO WE PROCESS AND FOR WHICH PURPOSES?
1. From all visitors to the JobCloud platforms
The following personal data is collected every time you access the JobCloud platforms:
- IP address of the computer requesting access
- Date and time of access
- Website from which the access was made (URL of the website user comes from, possibly with the search word used)
- Name and URL of the retrieved file
- Performed search queries
- Operating system of the computer
- Type of browser used
- Mobile phone device type, if one is used
- Transfer protocol used, headers e.g. authorization, location, date and content-encoding
This data is used for security purposes and to clarify cases of unauthorized use or cyber-attacks, for error and performance analysis and to optimize our services. Some of these processing operations are carried out by cookies. Read more about this in our Cookie Notice.
2. From job seekers in connection with the creation of the JobCloud user account
As a job seeker, you can register a JobCloud user account on the JobCloud platforms (hereinafter “JobCloud user account”). We use the registration and login service of OneLog. OneLog is a free registration and login service provided by OneLog AG. When you register to create a JobCloud user account with OneLog, OneLog AG, as the data controller, collects the following personal data:
- Email address
- Password
OneLog transmits the e-mail address to JobCloud and JobCloud also processes it as the data controller. For more information on how OneLog processes your personal data, please consult OneLog’s privacy policy, available at https://onelog.ch/assets/privacy-policies/en-privacy-policy.pdf.
We process your email address during the registration period for the following purposes:
- To fulfil and execute contractual and legal obligations
- To manage and maintain the customer relationship
- To verify access permissions and manage the JobCloud user account
We process your personal data as long as your JobCloud user account exists. To completely delete your JobCloud user account, click on the link in the settings in your profile to be redirected to your OneLog profile and perform the deletion. If you no longer have your JobCloud user account credentials in order to delete it, please contact our support team using the online contact form.

Further options for registration with a Social Media Account
As a job seeker, on some of our platforms you can create an account with your social media account of Google, Facebook or LinkedIn. To register, you will be redirected to the respective social media website, where you can log in with your existing user data. This will link your social media account and our service. By linking, we automatically receive your name and email address from the respective social media account. This information is necessary for the use of our services to be able to identify you. For further information about the social media login and privacy settings, please see the privacy policy and terms of use of the respective social media provider.
3. From job seekers with a JobCloud user account in connection with their JobCloud profile
You can create a profile in your JobCloud user account and determine whether and which personal data you enter in your profile (e.g. first and last name, address, phone number, profession, interests, etc.) and/or upload documents (e.g. CV, template for cover letters, etc.) to your profile. Please do not provide any personal data that qualifies as particularly sensitive personal data under the CH FADP and as a special category of personal data under the EU GDPR (e.g. skin colour, political opinion, denomination, union membership, fingerprint, iris scan, diagnostic data, medical history).
In your profile, you can view and manage the information and settings for our services.
Visibility of profile data: As a registered user, on some of our platforms, you can choose between two profile settings: you can set your profile to visible or not visible to our business customers. This function can be changed by you at any time in the settings. If your profile is set to “visible”, parts of your profile (esp. work experience) can be viewed by our business customers. Your photo and contact details will remain hidden for privacy reasons. Our business customers can contact you if they find your profile interesting. After our business customers have contacted you, you decide whether to give them access to your complete profile.
Please note, however, that if you grant them access and thus also make your personal data visible, the personal data could be downloaded by them (who may also be located outside Switzerland) and theoretically passed on to third parties worldwide without encryption. Once you have granted access, we will not be able to recall your personal data.
We will keep the data stored in your profile for you as long as your JobCloud profile and JobCloud user account exist. You can delete the data independently at any time in the profile settings.
4. From job seekers for our services
Numerous online services are available to job seekers with and without a JobCloud user account on the JobCloud platforms. We use the personal data provided to us if and insofar as this is necessary for the provision of services that you use.
Notifications for job seekers with a JobCloud account
In the apps, you will receive in-app push notifications. You can control and unsubscribe from receiving the notifications or push messages in the apps mentioned below at any time in your profile settings.
Job Alerts
We save parameters of your job search (profession, keyword, company, language, etc.) and send you suitable job offers by email.
Job watch list
We save job listings that you have selected for your watchlist and send a weekly reminder about your saved jobs by email.
Job recommendations
Based on the jobs you viewed and given your consent to receive recommendations, you will automatically receive job recommendations via email. The selection of job offers in these emails depends on the search parameters you specify, your user behavior and your profile information.
Company news
We store the names of the companies you want to follow and inform you by email about updates on these companies (e.g. new job advertisements).
Application for a published listing
If you apply for a job advertisement, JobCloud will either (depending on the JobCloud customer’s choice) i) redirect your application to the JobCloud customer’s application management system for your application process or ii) save your application in the respective customer’s own application management system or in the application management system integrated with JobCloud on the JobCloud platforms.
If your application is redirected to the customer’s system (i), JobCloud generally does not have access to your data and you will be interacting directly with the customer’s career page or to the page specified by the customer.
If customers use JobCloud’s application management system or their own application management system integrated on the JobCloud platforms (ii), you will be shown the JobCloud application form. Your application will be submitted to the JobCloud customer’s own application management system or to JobCloud’s integrated application management system. In this case, JobCloud is also aware of your data.
JobCloud’s customers are responsible for the data processing and deletion of the applications received in accordance with data protection regulations as independent data controllers.
In principle, the following data is collected: first and last name, contact details and application documents (CV, cover letter, etc.).
If you have a JobCloud user account, you can automatically fill in the application form with the information contained in your profile (Quick Apply) and have your cover letter created and submitted using the cover letter generator (see also AI applications).
If JobCloud customers use a questionnaire for their job advertisement, the answers to the questions will also be sent to the JobCloud customers. Your application will be stored in the JobCloud customer account and the JobCloud customer you applied to will be able to view your application documents.
JobCloud can inform you about the status of your submitted application, provided JobCloud has this status information. Status information is information about the status of your application to JobCloud customers and may include, for example, the receipt and processing of the application. JobCloud can only display status information if JobCloud customers provide JobCloud with this information. JobCloud cannot verify this information.
If you have a JobCloud account, we will store submitted applications in an application history visible to you in your profile for as long as your JobCloud account exists. If you interrupt your application, we will save your progress to your profile so you can continue working on it later. We will remind you of your interrupted application by email. The draft of your application will remain stored in your profile until you delete it yourself.
As a job seeker without a JobCloud account, you can also use selected services (in particular job search, sending applications) without registering. When searching for a job, we store personal data as mentioned in Section F above. If you use the application function and apply via the JobCloud platforms for a job advertisement using JobCloud’s application form, you decide for yourself which personal data you provide for this purpose. Typically, these are first and last names, email address, address, phone number, profession and biographical information on CV and interests. In this case, JobCloud will store your data for six months.
Application for a published job advertisement by email
Job seekers can apply for a job via email directly on our platform. After clicking on the button ‘Write an email’, job seekers can fill out an online form (first name, last name, email address) with a personal message and with attachments (e.g. CV). Once the email has been successfully sent to the recruiter, job seekers receive a confirmation email with the content of sent email and the email address of the recruiter for further communication ow up. If you have a JobCloud account, we will store submitted applications in an application history visible to you in your profile for as long as your JobCloud account exists. For job seekers without a JobCloud account, JobCloud will store their data for six months.
Salary calculator
If you use the salary calculator function, we store data such as the job title, professional experience, industry, place of work, working hours, annual gross salary, age and other data that you enter. Although this information is technically linked to your user ID (internal JobCloud ID) if you have a JobCloud user account, the salary information is evaluated anonymously and used to improve our statistical salary calculator model and to provide you with more detailed information in the salary calculator.
Spotted – Digital Recruiting
Spotted – Digital Recruiting means that JobCloud analyses and evaluates your personal data, compares it with current job offers and suggests suitable job offers (e.g. by email, SMS or phone). Specific Spotted Terms of Service and a specific Spotted Privacy Policy apply in this regard.
User Support
If you contact our support team with your questions about our services using the online contact form on our platforms, we will process your contact details, your name and the content of the message in order to respond to your request and improve our services.
5. For marketing and market research
We use your contact information to send you information about job-related products and services or about job offers via our newsletter with tips on job search, applications and current information about the JobCloud platforms or by other means, e.g. by email, post, phone or SMS. You can object to this processing at any time in writing, by phone, by email or in any other way, in whole or in part, using the contact details mentioned in Section C above. Users with a JobCloud user account can also exercise the right to object to newsletters in their profile. You can also unsubscribe from newsletters and marketing emails at any time by clicking on the “unsubscribe” link provided in each email.
Based on the information stored with us (profile data as well as first and third-party cookies), individual offers can be displayed to you on the JobCloud platforms or on other websites and social media pages. These may be offers that you can find directly on the JobCloud platforms or products and offers from third parties that may be of interest to you.
We occasionally ask our users to participate in market research. Any additional personal data you provide will only be used as part of this market research with your consent.
6. Cross-device personalization
If you use our services and log in to your JobCloud user account accordingly, we can associate your JobCloud user account with the device you are using and, depending on your settings in your profile and with regard to cookies, personalize your user experience and our offers on other devices that you use for our services (e.g. with regard to product recommendations and our offers in the Job Coach area on the JobCloud platforms).
7. From job seekers in connection with company ratings
When you submit a company rating to the JobCloud platform, we store the following information: employee status (applicant, current employee, former employee), contract type (temporary, permanent, etc.), content of the review and the email address. The review will be displayed anonymously and treated confidentially. The email address is required so that we can contact you if questions arise about your review and to handle complaints related to your review. Your ratings and personal data will be deleted if you request the deletion or if the rated company has their profile deleted.
8. For product development and improvement of our services
We use personal data that we receive directly from you or that is collected via cookies for analytical purposes in order to improve the user-friendliness and the functionality and quality of the JobCloud platforms.
We use quantitative analysis and predictive models to gain data-driven insights to evaluate and improve our products and services for you. Personal data (e.g. a user ID) is only used to analyse the use of the JobCloud platforms by different groups of job seekers and to strategically plan the new products. The analysis does not focus on individual users but is only about recognizing patterns in general to create a new product or to enable business decisions about our products and services.
JobCloud also presents third-party offers on the JobCloud platforms as well as in its emails and newsletters or provides links to third-party offers or websites (e.g. job offers from employers). By redirecting clicks or otherwise, we may track the way you use these links to improve our services and compile statistics.
9. Use of personal data in connection with AI applications
We use personal data in connection with AI applications. For more information on this, please consult the section “HOW DOES JOBCLOUD USE YOUR DATA FOR AI APPLICATIONS/SYSTEMS?”
10. Prevention of criminal offences, mediation and compliance with legal requirements
Your personal data may also be used to detect or prevent fraud or other illegal activities. Reports regarding illegal content can be made to JobCloud either via https://www.jobs.ch/en/contact/ https://www.jobup.ch/en/contact/ or directly to the job advertisement via the button “Report this job”. For details on reporting and remedying illegal content, please refer to the Job Seeker Terms of Service. If you make use of your rights as a data subject, we process your personal data for the processing of these inquiries in compliance with the statutory processing and retention periods.
G. COOKIE AND TRACKING TECHNOLOGIES
JobCloud uses cookies and other similar tracking technologies, including third party technologies on the JobCloud platforms and the company’s apps, email communications and other online services. They are used to enable, improve, personalize and analyse the use of our services and for the purposes of personalized advertising. Our Cookie Notice explains what these technologies are and why and how we use them, as well as your rights to control our use of these technologies.
H. CONDUCTING COMPETITIONS
We regularly run competitions. For this purpose, we only use personal data that we have collected specifically in the context of the competition and with the express consent of the participants (e.g. first and last name, contact details, address data). The respective terms and conditions of use and the respective privacy policy apply to the implementation of competitions and the processing of personal data and data retention in the context of competitions.
I. JOBCLOUD ON MOBILE DEVICES
We offer apps for various mobile devices, as well as a mobile-friendly version of our websites. These apps and mobile websites collect and process your personal data in the same way as the JobCloud platforms; this Privacy Policy applies. With your consent, we will send you push messages with information about your job search.
J. THIRD-PARTY OFFERS
JobCloud also presents third-party offers on the JobCloud platforms as well as in its emails and newsletters or provides links to third-party offers or websites (e.g. for webinar providers). JobCloud assumes no responsibility for the collection and processing of personal data by third parties and their services and applications. The relevant privacy policy of the third-party provider applies.
K. SOCIAL MEDIA PROFILES/PAGES
JobCloud operates social media profiles/pages to inform you about offers, events, services, promotions, competitions, news about the company and to interact with visitors to the social media profiles and our users. For details on data processing, please refer to our privacy policy on the respective social media platforms (Facebook, X, YouTube, Instagram, TikTok, LinkedIn).
L. TO WHOM DO WE DISCLOSE THE DATA AND IN WHICH COUNTRIES ARE THE RECIPIENTS?
Within the scope of our business activities and the purposes listed in this Privacy Policy, we also disclose personal data to third parties where permitted and where we deem it appropriate, either because they process it for us or because they wish to use it for their own purposes.
1. Categories of recipients
Submission of applications to or activation of profile data for business customers
If you apply for a job as a job seeker via the JobCloud platforms, we will forward your application to the relevant business client. If you have a registered account, on some of our platforms you can make the data stored in your JobCloud user account accessible to the business customer as described under the section “From job seekers with a JobCloud user account in connection with their JobCloud profile”, “Visibility of profile data”. The subsequent processing of your data by business customers is subject to the data protection regulations of the respective business customers. You are the independent controller of your personal data. For inquiries regarding the processing of your data (e.g. request for deletion of the data), please contact the respective business customer directly. The business customer is usually based in Switzerland, but we cannot rule out disclosure of your data by the business customer or access from abroad. Of course, JobCloud strives to protect your data as much as possible, in particular through contracts with business customers.
Providers
To provide our services, we use the following categories of service providers, among others: hosting providers, cloud service providers, providers of parsing and matching solutions, advertising service providers, tracking technology providers and social media platforms. Certain of our group companies act as our service providers. Our service providers are mainly processors and are therefore bound by data processing contracts to process your data confidentially and exclusively on behalf of JobCloud in compliance with suitable security measures. However, if they are responsible in exceptional cases, we will ensure that a transfer takes place within the scope of what is legally permitted.
Authorities and other parties in possible or actual legal proceedings
We transfer your personal data to authorities if we are requested to do so within the framework of our legal obligations or if it is necessary to assert our rights. In the event of legal proceedings (or imminent proceedings), if this is necessary to assert our rights, we will disclose the relevant personal data.
Purchasers or interested parties in the acquisition of JobCloud or business units of JobCloud
We disclose personal data to acquirers or interested parties in the acquisition of business units of JobCloud, insofar as this is necessary for the examination or implementation of corporate transactions such as company acquisitions, sales and mergers as well as for business continuation.
2. Transfer abroad
Your personal data will usually be processed in Switzerland and in the EU countries. However, our recipients may be based worldwide and thus also outside Switzerland or the European Union. If your data is exceptionally processed outside Switzerland and the EU, it will mainly be processed in the USA and Serbia. In principle, we only transfer your personal data to recipients in countries for which the EU Commission and the Swiss Federal Council have decided that they have an adequate level of data protection. If, exceptionally, we transfer your personal data to a country without adequate legal data protection, we contractually oblige the recipient to comply with the applicable data protection (for this we use the revised standard contractual clauses of the European Commission, which can be found here: https://eur-lex.europa.eu/eli/dec_impl/2021/914/oj? including legal adaptations for Switzerland), unless the recipient is already subject to a legally recognized set of rules to ensure data protection and we cannot rely on an exemption clause. An exception may apply in particular to legal proceedings abroad.
M. HOW DOES JOBCLOUD USE YOUR DATE FOR AI APPLICATIONS/SYSTEMS?
JobCloud uses artificial intelligence (AI) techniques in selected areas. This refers to systems and applications that work on the basis of training and not on the basis of human programming. They are thus able to recognize patterns or to create or change content. No AI systems prohibited within the meaning of the European AI Regulation are used. The output from AI systems is not used for automated decision-making in individual cases, including profiling within the meaning of Art. 21 CH FADP and Art. 22 EU GDPR for job seekers. We have regulated the use of AI within the framework of internal AI governance, weighing up opportunities and risks in advance and ensuring appropriate human supervision. If we offer dialogues with an AI, we make this clear and, if necessary, also point out possible errors.
As it is important to us to keep up with technical progress in order to be able to offer you even more efficient and better services, we use selected personal data that you provide to us or that we collect from you – as described in this Privacy Policy – in order to (i) develop our own AI techniques, (ii) train, (iii) test and (iv) validate and (v) use. This means that we use AI, for example, to optimize your search results or to better understand which requirements are crucial for a job. Note that our AI techniques may be based on third-party AI systems. We carefully select such third parties and enter into appropriate data protection agreements. We currently use the AI techniques listed specifically below, where we use a private AI model with an AI environment built for JobCloud specifically and to be used exclusively by JobCloud.
1. Recommender for job recommendations
We use your activity data (such as job views, bookmarking, sending application) to enhance job search and recommendations for you and other users of the JobCloud platforms through our recommender system. By analysing your interactions, we can tailor job recommendations to your preferences. The behavioural data is collected by cookies (for more information see the Cookie Notice). We use the data obtained in this way exclusively to improve our statistical model and to display job recommendations tailored to your search behaviour and your interests online or, if you are a registered user, to send you an e-mail.
2. Cover letter generator
When creating your cover letter, you can use a cover letter generator. For this purpose, your profile information and the details of the job advertisement are used, and a text is generated using generative artificial intelligence. We use a privacy-friendly product from Microsoft Azure OpenAI, which allows extended data protection and guarantees use on European servers in a secure IT environment. We do not analyse the content of the cover letter.
3. Job matching
If you apply for the job advertisement of JobCloud customers via the JobCloud platforms, a comparison can be made between your application documents and the customer’s job advertisement if sufficient data is available for the analysis. We use our own matching technology developed at JobCloud for the comparison. We extract data from the application documents and/or, if access has been granted, the data from your profile and CV on the JobCloud platforms, and from the requirements of potential employers in pseudonymized form, which are then matched in a second step with the help of AI to enable a preliminary statement about the possible match.
There is no automatic decision-making or profiling. The potential match statement is used by the business client to support the selection of suitable candidates for the advertised position but does not replace the decision to reject or hire the candidate by a human being.
N. DATA SECURITY
We use technical and organizational security measures to protect the managed data against accidental or intentional manipulation, loss, destruction or access by unauthorized persons in accordance with the current state of the art. The security procedures are continually enhanced as new technology develops.
We use Google ReCAPTCHA to protect our websites against bots and spam software in the best possible way and to protect them from misuse by non-human visitors. In order to protect and optimize our services and to combat cyber-attacks, certain technical data is collected using cookies. Further information can be found in the Cookie Notice at the end of this Privacy Policy.
O. HOW LONG DO WE KEEP YOUR DATA?
The personal data you have stored in your JobCloud user account will be available to you for the duration of the contract and will be stored by us for this period. We store the application data of job seekers without a JobCloud account for a period of 6 months.
The personal data will be permanently and irrevocably deleted or anonymized if (i) you delete individual data or your profile yourself or instruct us accordingly or if the contract ends, i.e. if you or we terminate the contract, (ii) the 6-month period for job seekers without a JobCloud user account has expired and (iii) we do not need the data for the execution of the contract, we are not legally obliged to store it or we do not need it for the assertion, exercise or defence of legal claims or other overriding interests.
Please note that for technical and/or organizational reasons, it may take a few days for your data to be permanently and irrevocably deleted.
We use personal data that is not directly connected to your JobCloud user account for as long as this is necessary and we are entitled to do so. After this period, we will permanently and irrevocably delete or anonymize all your personal data. Specific information on deletion can also be found in the corresponding sections of this Privacy Policy.
P. WHAT ARE YOUR RIGHTS?
Within the scope of the data protection law applicable to you and to the extent provided for therein, you have the right to access, correction, and deletion, the right to restrict data processing and to object to our data processing, as well as to have certain personal data handed over for the purpose of being transferred to another entity (known as data portability). Insofar as you have given us your consent to process your personal data for certain purposes (e. g. when you register to receive newsletters), we process your personal data within the framework of and based on this consent, insofar as we have no other legal basis and we need it. Consent given can be revoked at any time, but this has no effect on data processing that has already taken place. Please note, however, that we reserve the right to enforce the limitations imposed by law, such as when we are obliged to retain or process certain data, have an overriding interest in doing so (as far as we may invoke it), or require the data to assert claims.
Each person also has the right to enforce their claims in court or to lodge a complaint with the competent data protection authority.
